Terms of Service

These terms govern the use of the PlugMesh customer data platform (the “Service”). By creating an account or using the Service you accept them.

If you have a separately signed service agreement with us, that agreement prevails in case of conflict.

1. Definitions

  • Customer: the business that opens a workspace to use the Service.
  • Workspace: the Customer’s environment, whose data is isolated from other customers.
  • User: a person invited to the workspace by the Customer.
  • End-customer data: personal data belonging to the Customer’s own customers that is loaded into the workspace.

2. Accounts and security

  • The Customer is responsible for keeping account information accurate and up to date.
  • Keeping user credentials confidential, assigning roles and revoking access for departing staff are the Customer’s responsibility.
  • You must notify us without delay if you suspect unauthorised access.

3. Fees and invoicing

  • The Service is priced on usage: a fixed workspace fee plus amounts calculated on processed events and monthly tracked profiles (MTU).
  • The applicable unit prices, discounts and currency are visible in your workspace’s billing settings.
  • Invoices are issued at the end of each period; unless agreed otherwise, payment is due within 14 days of the invoice date.
  • Fees are exclusive of VAT and similar taxes.
  • If payment is late, we may suspend the Service for amounts that remain unpaid 15 days after written notice.

4. Acceptable use

When using the Service you agree not to:

  • Send unsolicited commercial messages (spam). Obtaining the necessary consents, complying with applicable law — including registration with Turkey’s İYS — and honouring opt-out requests are the Customer’s responsibility.
  • Send content that is unlawful, misleading or infringes third-party rights.
  • Upload personal data that is not yours or that you have no legal basis to process.
  • Reverse engineer the Service, attempt to obtain its source code, or circumvent security measures.
  • Place unreasonable load on the infrastructure, work around rate limits, or resell the Service without our written consent.
  • Process special categories of personal data (health, biometric, belief and similar) without a separate written agreement.

5. Third-party platforms and integrations

  • Connecting Shopify, Meta (Facebook/Instagram/WhatsApp), İkas, WooCommerce, Ticimax, Ideasoft and email/SMS/voice providers is optional and subject to each platform’s own terms.
  • Complying with those terms — including the Shopify API License Agreement, the Meta Platform Terms and the WhatsApp Business Messaging Policy — is the Customer’s obligation.
  • We are not responsible for outages, rate limits, API changes or account decisions made by third-party platforms.
  • If a platform restricts our access we may modify or discontinue the related feature.

6. Data protection and processing

  • For end-customer data the Customer is the controller and PlugMesh is the processor.
  • We process that data only to provide the Service and on the Customer’s instructions.
  • We apply appropriate technical and organisational measures and bind our staff to confidentiality.
  • We may use sub-processors; we share the current list on request and announce changes with reasonable notice.
  • We provide reasonable assistance with deletion, correction and information requests; see the Privacy Policy for details.
  • A separate Data Processing Agreement (DPA) is available on request.

7. Intellectual property

  • All rights in the Service, its software, interface, brand and documentation belong to PlugMesh.
  • The data and content you load into your workspace remain yours; we use them only to provide the Service.
  • We may use feedback you send us to improve the product, without this creating any obligation in return.

8. Availability, maintenance and support

  • We use reasonable efforts to provide the Service without interruption; no service level (SLA) commitment applies unless agreed in writing.
  • We announce planned maintenance in advance whenever possible.
  • Features marked beta or experimental are provided “as is” and may change without notice.
  • Support is available on business days at hello@getplugmesh.com.

9. Suspension and termination

  • We may suspend the Service for late payment, breach of acceptable use or a security risk, giving prior notice where possible.
  • The Customer may terminate at any time by closing the workspace; fees already accrued remain due.
  • After termination you have 30 days to export your data; at the end of that period data is deleted as described on the Data Deletion page.

10. Disclaimer of warranties

To the maximum extent permitted by law the Service is provided “as is”. No implied warranty of fitness for a particular purpose, uninterrupted operation or error-free performance is given. We make no commitment as to campaign results, delivery rates or the behaviour of third-party platforms.

11. Limitation of liability

  • We are not liable for indirect damages, loss of profit, loss of data or business interruption.
  • Our total liability is limited to the fees you paid in the 12 months before the claim arose.
  • These limits do not apply to wilful misconduct, gross negligence, or where the law does not permit limitation.

12. Indemnity

You agree to cover the losses arising from claims brought against us by third parties or authorities because of the data you loaded into your workspace, the messages you sent, or your breach of the acceptable use rules.

13. Confidentiality

Each party must protect the trade secrets and confidential information it learns in the course of the relationship and use them only to perform the agreement.

14. Changes

We may update these terms. Material changes are announced by email or in-app notice at least 15 days before they take effect. If you do not accept a change, you may close your workspace.

15. Governing law and jurisdiction

These terms are governed by the laws of the Republic of Türkiye. The Istanbul Central (Çağlayan) Courts and Enforcement Offices have jurisdiction over disputes.
